Judicial Power ratifies: Rutas de Lima must suspend toll collection in Villa and Punta Negra

He Judiciary ordered that the company Lima Routes immediately suspend the collection of the tolls located in the sectors of Villa and Punta Negraafter declaring the request presented by the District Municipality of Santa María del Mar. The measure was issued within the framework of file 01554-2024, in which a habeas corpus was evaluated against the concessionaire.

The judge Patricia Romero Medinaof the Preparatory Investigation Court of Pachacámac, resolved that the sentence issued on October 13, 2025 must be executed without waiting for the result of the appeal filed by Lima Routes. According to the judge, a situation of irreversibility or disproportionate damage is not generated for the company, since the payment could be restored if the ruling is revoked.

The judicial resolution emphasizes that continuing with the Toll collection violates the freedom of movement of southern neighborswho are forced to pay to leave their homes due to the lack of alternative routes. Mayor of Santa María: “We hope that the collection of other tolls will be resolved favorably”

The mayor of Santa Maria del MarHugo Monteverde, expressed his agreement with the court’s decision by pointing out that the resolution unambiguously clarifies that Lima Routes had to suspend the collection of tolls from the moment it was notified. Furthermore, he expressed his expectation that the Superior Court of Justice of Lima South rule in the same sense regarding tolls Villa Bridge and Conchanso that collections at those points are also suspended.

“Satisfied with the decision of the court who has clarified the sentence and which leaves no doubt that Ruta de Lima should have suspended from the day we were notified of the sentence (…) We hope that the superior court of justice of southern Lima also resolves favorably so that the collection of the other tolls, the town bridge toll, the Conchán toll, is suspended,” said Via Exitosa.

Monteverde explained that the concessionaire resumed collection of tolls arguing that the judge had not specified from when the suspension should be applied. However, he clarified that The sentence was sufficiently explicit in warning that the company would be sanctioned if it did not comply with stopping the collection immediately.. He added that, after the new resolution and official notification, the concessionaire should comply with the court order within hours.

Through a statement, Lima Routes informed that it has suspended the collection of tolls in the units of Villa and Black Tipafter being notified with a new resolution issued by the First Preparatory Investigation Court of Pachacámac. The concessionaire indicated that the measure will be complied with immediately, although it recalled that on November 2 it resumed collection in application of the rights that, according to it, the current legal framework grants it.

The company described the judicial decision as another example of the “arbitrary treatment” that it would be receiving from the Peruvian state. Along the same lines, he specified that the tolls Huaylas, Saint Peter, Arica and Dry Gorge They will continue to operate normally, since there is no court order ordering their closure. The company requested support from the public force to protect the safety of its personnel and warned that it reserves the right to take legal action against state decisions.

Municipality of Lima supports judicial decision and demands compliance with the sentence

The Municipality of Lima (MML) highlighted the resolution of Judiciary that orders Lima Routes immediately suspend the collection of tolls in Villa and Black Tipafter having resumed collection despite a ruling in force since October 13. According to the commune, the concessionaire incurred contempt by relying on an appeal to ignore a ruling that recognized the violation of citizens’ right to free movement.
