Judicial Evaluation Committee maintains suspension; asks the Court to resolve

Now, in order for the SCJN to definitively resolve this jurisdictional conflict, the Evaluation Committee of the Judiciary filed the appeal today, hours before the 24-hour period imposed yesterday by the Superior Court expired, and in the that the evaluators were warned that a sanction would apply in case of non-compliance.

According to the Law, this could be a warning; admonition; fine of 50 to 5,000 times the Measurement and Update Unit (UMA) or double in case of recidivism, as well as in extreme cases and assistance from public forces and arrest.

The lack of definition regarding the validity of the judicial reform and the election of judicial positions is sustained, given that in October the SCJN learned of the unconstitutionality actions filed against those amendments, but only rejected the draft sentence that was presented to it and, given that the eight votes necessary to declare the partial invalidity of the constitutional reform would not be reached, did not address that underlying issue.

For this reason, in fact the reform is still in force, although judges, collegiate courts, TEPJF and the National Electoral Institute (INE) have supported conflicting criteria.

Thus, through various means, the Court has been asked to exercise its power to concentrate the indirect amparo proceedings filed against the reform, to resolve this as a priority and to define the criterion to prevail in the face of contradictions.

They impose fines

Meanwhile, the same judge Santamaría Chamú, who had also ordered the suspension of tasks of the Evaluation Committees of the Executive and Legislative Branches, decided to fine the members of those bodies, who continue with the interview stage to define the candidates for judicial charges.

For disobeying the suspension ordered on December 20 within the framework of the analysis of an amparo trial, the judge determined to impose a fine of 107,579 pesos on the evaluators.

In addition to this sanction, there are also those that have been imposed on the eleven counselors of the National Electoral Institute (INE), who have been fined as repeat offenders, for continuing with the organization of the judicial election.

In this case, it was Judge Francisco Javier García Contreras, head of the second district based in Colima, who has ordered the Institute to suspend tasks since November without his order being followed.

Until the end of December, each of the directors had already accumulated three fines for a total of 162,855 pesos each (the amount of each fine was 54,285 pesos). They have also been reported to the Attorney General’s Office (FGR) for contempt.

Judge Santamaría Chamú has also issued orders to suspend the process to the INE advisors.
