This Tuesday, November 5, the Court will discuss a project by Minister Juan Luis González Alcántara Carrancá in which it is proposed to invalidate the most important part of the judicial reform: the popular election of federal judges and magistrates.
For the draft sentence to be approved, it requires a qualified majority of eight votes from the full Court.
The project also proposes invalidating the transitional provisions that order the removal of District judges, Circuit magistrates and regional magistrates of the Electoral Court, as well as the popular election of District judges and Circuit magistrates, but maintains the election of the ministers of the Electoral Tribunal. It will also invalidate the reduction in salaries for current District Judges and Circuit Magistrates, although it does not apply to those who join later.
Furthermore, it proposes invalidating some powers of the Disciplinary Court and the unassailable nature of its resolutions, as well as the regime applicable to federal entities, which would only enable their administrative body and their court of justice.
The minister proposes invalidating the figure of “faceless judges” and the selection method of the Evaluation Committees.
This draft resolution corresponds to the unconstitutionality actions promoted by national and local political parties, as well as deputies of local congresses against the reform of the Judiciary.
Just this Friday, the Jufed announced that a federal judge based in Morelia, Michoacán, granted a provisional suspension against the judicial reform.
Judge Sergio Santamaría Chamú granted the suspension that benefits judges and magistrates assigned to the association to avoid the mass dismissal of justice providers.
