In interview with Political Expansionthe director of the National Association of Circuit Magistrates and District Judges of the Judiciary (JUFED), Juana Fuentes, estimated that between 400 and 500 judges and magistrates will “drop out” of the elections contemplated by the judicial reform.
“It’s a big number. I estimate that they take around 400 or 500 people who have expressed their desire not to participate,” he commented.
As of Tuesday afternoon, the Senate had accumulated 412 declinations of judges and magistrates… and counting. Of that total, 157 are judges, and 255 are judges who decided not to participate.
One of these cases is that of the sixth district judge in Commercial Matters based in Zapopan, Jalisco, Sandra Karina Ibarra Carbajal, who appeared yesterday at the Senate Parties Office to present her written decline to participate in the elective process. .
The decision of judges and magistrates not to participate will imply the loss of judicial career profiles that took even decades to reach those positions. But the jurisdictional bodies will not remain headless. The judges who declined will leave until August 2025, when the next judges take office.
The director of the Jufed pointed out that there are also judges whose position will be at stake in the 2027 elections, and not in 2025, who will remain in office for the following years, but others who have decided to decline once and for all, such as the judge Juan Pablo Gómez Fierro, who stopped reforms by former president Andrés Manuel López Obrador.
“Some express that they are going to present their declination document at once and wait until 2027 and that depends on the situation that prevails in each of the judges. Some say they will leave in 2025 and others will wait until 2027, but if the need to express the need declines,” he said.
Among the judges who will not participate are:
- Ivan Zamarripa. District Judge in Durango.
- Magdalena Victoria Oliva. Fifth District Judge Specialized in Execution of Sentences based in Mexico City.
- Isaura Romero. District Judge in administrative matters in Jalisco.
- Reyna Rodríguez. District Judge of the Fourth Federal Labor Court for Individual Matters in Guanajuato.
- Juan Pablo Gómez Fierro. Magistrate of the Fourteenth Collegiate Court in Administrative Matters of the First Circuit in CDMX.
- Efraín Frausto. District Judge of the Federal Criminal Justice Center in Guanajuato.
- Livia Lizbeth Larumbe Radilla. Magistrate of the First Collegiate Labor Court of the Sixth District in Puebla.
- Gloria García Reyes. Judge of the Sixth Collegiate Labor Court of the Sixth Circuit in Puebla.
- José Ybrain Hernández Lima. Circuit Judge of the Sixth Collegiate Labor Court of the Sixth Circuit in Puebla.
- Martín Ubaldío Mariscal Rojas. Magistrate of the First Collegiate Court in Criminal Matters of the Sixth Circuit.

Juana Fuentes emphasized that she will decline to participate in the elections, but her position will participate in the 2027 elections, so she has not yet determined whether she will leave her position at once or within three years.
“I am clear that I will decline. I am in the generation of 2027 and it is one of the things that I value. It is not a simple decision, considering the Association. The decision is that I am going to decline, I just don’t know when, because I am from the 2027 generation and we have the JUFED board, because we have a commitment with judges and magistrates,” he commented.
In total, there are 850 positions for District judges and Circuit magistrates that will be at stake in the 2025 elections; Of them, in 711 there is currently a judge occupying the position and 139 are vacant.
These judges – in addition to the ministers – must notify the Senate, in writing, of their intention to run for office, or that they will not participate, since the reform of the Judiciary and secondary laws establish that these judges, When they are in office, they immediately have a direct pass to the candidacy.
Although October 26 was the last day for acting judges to present their intention to run for office, this Wednesday will be the last day to present their decline to run for office.
Those ministers, magistrates and judges in office who do not present their decline or declaration to participate within the established deadlines will remain on the list of candidates with a direct pass to compete in the 2024 elections.
The final list of the judges who declined to participate in the election, and of those who expressed their intention to run, will be announced today on the Senate website.
And on February 12, the Senate will deliver the final list of candidates for the more than 800 positions for District judges and Circuit magistrates that will be up for grabs in June 2025; This list will include the acting judges who have expressed their intention to compete, since they have a direct pass.
