Judge threatens councilors with a fine of $54,000 and trial if they do not stop the election

The second district court based in Colima warned the National Electoral Institute (INE) that it must suspend the organization and development of the 2025 electoral process to elect ministers, magistrates and federal judges, or it will impose a financial penalty of more than 54 thousand pesos to each director and will present a complaint to the Attorney General’s Office of the Republic so that they can be brought to trial for contempt.

The resolution, which was published as part of the amparo trial number 1125/2024, promoted by the Iris Foundation in Defense and Promotion of Human Rights, states: “the General Council of the INE is requested for the last time (…) so that in the within 24 hours from the date of duly notified of this provision, abide by the effects of the provisional suspension granted in this incident of suspension.”

The appeal granted establishes that the General Council of the INE must abstain to implement the extraordinary electoral process 2024-2025, and not issue agreements for the organization, development, counting, surveillance and inspection of the extraordinary electoral process of 2025.

Likewise, it states that the plenary session of the Federal Judiciary Council (CJF) must suspend the implementation of a work plan for the transfer of material, human, financial and budgetary resources to the Judicial Disciplinary Court with regard to the functions of discipline and internal control of the members of the Judicial Branch of the Federation (PJF), and the judicial administration body in what corresponds to their administrative functions and judicial career; In addition, it omits to issue general and specific agreements that are required to implement said work plan.”

He orders the Senate not to issue the call to integrate the lists of candidates who participate in the extraordinary election to renew the positions of the PJF, as well as omit to take oath of their commission to the winning judges in the eventual election on September 1, 2025, and avoid carrying out the adjustments to the federal laws that correspond to comply with the controversial decree.

Likewise, the ruling establishes impediments for the federal Chamber of Deputies, the local congresses and that of Mexico City, to comply with the decree that arose with the judicial reform.

In this context, he emphasizes that warns for the last time before making the enforcement measure effective, that if they do not comply with what is ordered, a fine of 500 units of measurement and updating (UMA) will be imposed on each of the members of the Council (of the INE) in accordance with the constitutional amendment regarding deindexation of the minimum wage established by the UMA, which corresponds to 54,285 pesos.
