SANTO DOMINGO.-After learning about the investigation of him by the Special Prosecutor’s Office for Administrative Corruption (PEPCA) and the suspension to which he has been subjected, Judge Juan Rodríguez Consoró said he felt harassed by the “innumerable insults and slander” expressed by the Public Ministry on his person.
He stated that these accusations have “an obscure purpose” for which he has decided to defend his honor and the position of judges independent of Dominican judges, and asserted that “honor is only the patrimony of the soul and the soul only belongs to God”.
Yesterday, the director of PEPCA, Wilson Camacho, revealed that judge Rodríguez Consoró is being investigated for alleged serious misconduct in the exercise of his duties.
For his part, Rodríguez Consoró said that he is not opposed to being investigated, even questioned, since he is a public servant “and judges receive our salaries from taxes from the people.”
Through a public letter, magistrate Rodríguez Consoró said that society has the right to know who administers justice and if the server is worthy of such a function.
“I am vilely and unjustifiably attacked by the Public Ministry, which is an interested party in the criminal process and the judges who are the impartial third parties are under the legal and constitutional obligation to restrain their arbitrary, abusive and outrageous actions against all citizens. “said the judge.
Likewise, it pointed out that the Public Prosecutor’s Office “given its well-known inefficiencies and investigative ineffectiveness”, persecutes and desires intimidation and moral reviling in the media with the aim of kidnapping the decision-making power and independence of judges.
“I do not see this attack as something harmful, only to my person, but as a ferocious attack on our Constitution and the foundations of our Magna Carta, since it is the nation’s own democratic system that is being seriously hit; it is the democratic and legal stability of the country, which is being injured to death, ”he said.
He said that during his tenure as a judge, he has acted correctly, attached to the Constitution, the law, ethics, and morality, “I have nothing to fear and nothing to hide, quite the opposite.”

Faced with the overwhelming persecution and innumerable insults and slander from the Public Ministry and people with dark purposes, I have decided not to remain silent and go out to defend my honor and the decision-making freedom and independence of Dominican judges, because honor is the patrimony of the Soul, and the Soul belongs only to God.
I am not opposed to being investigated and even questioned, because I am a judicial server, and judges receive our salary from taxes from the people and that fact alone gives society the right to know who administers justice and if that server is worthy of such function. However, I am being vilely and unjustifiably attacked by the Public Ministry, which is an interested party in the criminal process, and the judges, who are the impartial third parties, are under a legal and constitutional obligation to restrain their arbitrary, abusive, and outrageous actions. against every citizen.
A Public Ministry, which, given its already known inefficiency and investigative ineffectiveness, persecutes and wishes, under intimidation and moral reviling in the media, to kidnap the decision-making power and independence of judges. I do not see this attack as something harmful only to myself, but as a ferocious attack on our constitution and the foundations of our Magna Carta, since it is the nation’s own democratic system that is being seriously hit, it is democratic stability and the legal security of the country, who at this moment are being injured to death.
The indoctrination of judges, based on fear and public insult, is trying to deny all citizens the right to be tried fairly, following the rules of Due Process of Law, effective judicial protection and all the guarantees minimums that are accorded to them by the constitution and the laws.
We have a Public Prosecutor who wants to be a judge and a party, because PEPCA, not being benefited by our resolution, leaves the courtroom not to prepare the appeal of the case, in accordance with the double degree of jurisdiction agreed by law, but rather, who goes out to persecute the judge who has judged according to justice and the legally established parameters, because the desire of the Public Ministry has not been satisfied.
However, as the current Attorney General of the Republic, magistrate Mirian German, once said: “judges are not there to please anyone” and “the case theory of the Public Ministry is not proof”, expressions that we share with said magistrate. , who like me, was insulted and publicly accused without foundation. If pleasing the Public Prosecutor’s Office were the function of criminal justice, we would not need judges, but the Public Prosecutor’s Office itself would arbitrate its processes and it would decide them itself, this being affectionately what this body pursues, putting our function and triggering ridicule public.
This pernicious intention of the Public Prosecutor’s Office should draw the attention of the Dominican people, because in a country where there is a body, whatever it may be, that is understood to be a God of Olympus, that wants to place itself above good and evil, there is a very thin line towards despotism, because, in a democratic country, as stated in article 4 of our constitution, all organs need their counterweight, to maintain the democratic health of the State.
At the moment that this malicious, lying and servile network manages to rig the decision of the judges at their will, the citizenry as a whole is left, unprotected in their fundamental rights, because, if the judge cannot rule independently as established in our Charter Magna, the value of justice cannot be materialized.
The role of the judge is to apply the laws with a sense of justice and that of the Public Ministry is to accuse and present evidence that proves his accusation, and when we say evidence we are not referring to papers, but to the objective presentation of evidence that can justify the force of the entire repressive apparatus of the State against a citizen.
What society must understand is that the one who is persecuted by the Public Ministry is not me, who is really persecuted, it is the justice system and the independence of the judges; It is not me exclusively who they need to silence and indoctrinate, but all the judges in the country; It is not killing my morality, but killing the morality of justice. That is why they have taken me as cannon fodder, to sow terror in judges and thus immobilize them, so that they cannot decide cases independently. Persecuting me and trying to dismember my integrity is the response to the inefficiency clearly displayed by the Public Ministry to articulate their cases, given their lack of expertise to prove their accusations.
Let the country know that during my exercise in these dignified functions of judge, I have acted correctly, attached to the Constitution, the law, ethics, and morality, that I have nothing to fear and nothing to hide, quite the contrary, I exhibit with great pride all that I have and what I am, which are the immense fear and love of God, my family and the principles and values that my parents instilled in me and that have allowed me to have the strength and courage to put a stop to the extortions, abuses and outrages of an inefficient, inoperative, abusive, marginalizing Public Ministry, which feeds and feeds the morbidity.
But, in honor of the popular Roman phrase: “Bread and Circus”, we had to be a circus.
