The emblematic case ‘Waykis in the shadow’ has just jumped back into the center of public debate, but – this time – not because of new evidence or sentence, but because the judge in charge has just refused to apply the new law against organized crime congressional.
He Judge Richard Concepción Carhuancho declared said law inapplicable to the present specific case, for violating the rights to tranquility, personal security, truth and to live in a society free of corruption, violating the Political Constitution of Peru, the American Convention on Human Rights, and the Convention of the United Nations against Transnational Organized Crime and its protocols (Palermo Convention).
This decision of the First National Preparatory Investigation Court of the Judiciarywill undoubtedly generate a wide debate about compliance with the rule that prevents, among other things, the search without the lawyer of the investigated person present.
The aforementioned judge declared unfounded the exception of inadmissibility of action raised by the defense of Zenovia Herrera Vásquez, investigated in the emblematic case known as ‘Waykis in the shadow’.
Through the aforementioned technical defense means, it was sought to archive the investigation being followed for the alleged crimes of criminal organization and influence peddling, based on Law 32108, which modified Law Against Organized Crime.
