The resolution revealed by Infobae states that the delay affected the processing of file No. 00181-2015-59, linked to a criminal network processed by drug trafficking and extortion. The ANC concluded that the judge did not observe the proper procedural speed required by the Judicial Career Law.
The warning does not imply a suspension or affects the position currently occupied by the magistrate, but constitutes a serious offense registered in its file. The ANC also warned that the judge’s behavior violated the “promptness in the administration of justice” and ordered to send a copy of the resolution to the presidency of the National Superior Court.
ANC of the Judiciary considered that the delay was unjustified
According to the Anc-PJ ruling, the disciplinary process against Concepción Carhuancho opened following a complaint filed by the public attorney specialized in crimes against public order, who denounced the delay in pronouncements on civil reparation payments. The control body determined that the magistrate took more than three years to resolve requests that, by law, had to be met within five business days.
During his defense, the judge claimed that the delay was not attributable to him, since his office faced an overload of complex cases and had only a legal specialist, who was on maternity license during part of the period in question. In addition, he pointed out that the Covid-19 pandemic and the remote work system made physical access to the files difficult.
The ANC, however, dismissed these arguments. In his analysis, he concluded that the delay was not due to causes outside the judge, but to a lack of functional diligence, since the procedural burden does not exempt from complying with the established deadlines. Therefore, he decided to impose a written warning, a measure that also reached the judicial specialist Roxana Campos López, who did not present discharge within the legal period.
