Judge rejects demands from the Tizapa mine employers’ union

In a new attempt at “intrusion” in the Tizapa mine, in Zacazonapan, state of Mexico, the Frente employers union requested new benefits from the Peñoles company. However, a federal judge rejected the request because the only holder of the collective bargaining agreement (CCT) is the National Mining Union, headed by Napoleón Gómez Urrutia.

In the judge’s resolution it is stated that the employers’ union of Carlos Pavón, known among the miners as The Marranaargued that the employer has allegedly refused to grant category promotions to affiliated workers and salary advances “in violation of clause 66 of the collective contract.”

He also pointed out the people whose instructor status was removed, as well as the names of those whose shifts and work areas were changed, and that Peñoles is in breach of clause 33 of the CCT.

Román Jaimes Carbajal, district judge specialized in labor matters, assigned to the Federal Labor Court for Collective Affairs, based in Mexico City, dismissed the petition.

He explained that based on article 897-C, section III, of the Federal Labor Law, it is estimated that it is not possible to provide in accordance with what was requested, because the written and oral phase of the current procedure has concluded, pending the issuance of the corresponding legal ruling.

In April 2024, the Supreme Court of Justice of the Nation ruled that the National Mining Union is the holder of the CCT of the workers at the Tizapa mine, after denying protection to the protection union of Industrias Peñoles.
