Judge orders 30 months of preventive detention against march financier

Prosecutor's Office upholds request for preventive detention against Yaneth Navarro and Cirilo Jara

Judge Margarita Salcedo concluded today that there is sufficient evidence to establish that Yaneth Navarro encouraged and financed the violent marches, which occurred after the coup d’état of December 7, 2022, in order to restore the coup leader to the Presidency .

Salcedo ordered 30 months of preventive detention against Navarro on the grounds that if he remained free he could hinder the proceedings and investigations carried out by prosecutor Arturo Mosqueira.

The most compelling evidence is the audio that Navarro sent on December 10, 2022 to Gloria Castillo Terrones, Castillo’s sister, in which he assures that he kidnapped two police officers in retaliation for the former president’s vacancy.

“Our partner (Pedro Castillo) has been imprisoned, they have practically kidnapped him and we cannot allow it. We have taken two police officers hostage, we have risen up in protests calling for the release and reinstatement of Pedro Castillo. Companion Pedro has not made a mistake or a sin, ”he expressed in the voice recording.

The other evidence considered by the magistrate are the chats found on the cell phone of the investigated in which her coordination to deploy more protests in Lima and other provinces is corroborated.

Also the notebooks in which he recorded the expenses he made when paying protesters who traveled from the interior of the country to the capital.

“It can be established that (Yaneth Navarro) has money to hire people for the purpose of riots despite being unemployed, this allows us to estimate that she can carry out acts of obstruction given the power relationship and the visits (she made) to the Government Palace”, explained the head of the Fifth Preparatory Investigation Court.

According to the judicial resolution, Navarro Flores stirred up mobilizations for ten days, between January 19 and 29, and these only stopped when the teacher was arrested, on January 31.

For Judge Salcedo, in addition, the teacher does not guarantee family ties because she remained outside of Natividad, her town in Apurímac, for more than a month, since she was captured in Lima.

In this line, he said that the accused can flee from the action of justice.

Regarding Cirilo Jara, the judge rejected the request for preventive detention and ordered his appearance with restrictions and an 18-month impediment to leave the country. According to her criteria, there was no risk of escape or obstruction.

Jara recovered his freedom tonight. Prosecutor Mosqueira, for his part, did not appeal the resolution despite the fact that he did not get the 36 months in prison that he required against those investigated.

Keep in mind

– Judge Salcedo admitted evaluating the request for preventive detention only for the crime of disturbances, but not for criminal organization as required by the Prosecutor’s Office.

-“It is not admissible that the defendants are part of a criminal organization for the mere fact of having committed alleged crimes against public peace,” concluded the magistrate.
