The judge’s decision is recorded after the victory of Donald Trump in the US elections, who enacted an ironclad policy against illegal migrants
On Thursday, November 7, United States District Judge J. Campbell Barker annulled the “Parole in place” program -implemented by Joe Biden-, which gave legal status to undocumented migrants who married US citizens.
In this way, Judge Barker continued the administrative suspension that had occurred at the beginning of 2024 when Biden was running for re-election. Politics, he recalled cnnprotected certain undocumented spouses of U.S. citizens from deportation and allowed them to work legally in the country while seeking citizenship.
In the ruling, he noted that Congress did not give the Executive power to rule on the matter and, therefore, considered that “the history and purpose confirm that the defendants’ vision” of the relevant immigration law “stretches the legal interpretation beyond its breaking point.”
In addition, he rejected the request of several who were beneficiaries to intervene in favor of the program and defend it.

This “Parole in place” was going to benefit people without legal documents to reside in the US who were living there for at least 10 years, as well as the undocumented stepchildren of US citizens.
This decision comes after the victory of Republican Donald Trump in the presidential elections on November 5, who stated that his priority will be the shielding of the borders to make them “safe and secure.”
In his first term, he focused on the construction of a border wall to prevent the illegal passage of people, as well as making agreements with Mexico to allow migrants to stay in the Spanish-speaking country while their asylum application was processed. Now, in his campaign, he indicated that he was not against migration but wanted it to be done through legal mechanisms.
He also had a strong speech against Venezuelan migration, ensuring that many “criminals” and “crazy people” came to the United States, making Venezuela a “safe country.”
