Judge Carlos Ferreira de Aguiar, of the 12th Federal Court of Rio de Janeiro, granted the Union a period of 72 hours to express its opinion on the decree by President Jair Bolsonaro that granted constitutional grace to the sentence of federal deputy Daniel Silveira (PTB-RJ), sentenced last week by the Federal Supreme Court (STF) to 8 years and 9 months in prison for the crimes of attempting to prevent the free exercise of powers and coercion in the course of the process.
The decision was motivated by a popular action filed by two lawyers who intend to suspend the decree. After receiving the statement, the judge must decide the case.
In addition to the prison sentence, the deputy was sentenced by the STF to the loss of his mandate, the temporary suspension of political rights and the payment of a fine of R$ 200,000 for the conviction. However, the sentences will not be served immediately because there is still an appeal.
