Judge finds five subjects guilty for crime against renowned folklorist from Masaya

Almost 10 months after the murder of Cristian Eliezer Ruiz Álvarez, 43, a renowned folklorist from the city of Masaya and a member of sexual diversity, Judge Norman Andrés Duran Chávez, of the District Criminal Trial Court of this department, ruled guilty for five individuals arrested and charged by the Prosecutor’s Office for the crime of homicide.

The ruling was issued on May 29. According to the Police, of the five accused of the “hate crime” against Ruiz Álvarez, three of them have criminal records; Hilario Julián Ortíz Ortíz, 25, with a history of frustrated homicide, theft, and assault; Ervin Antonio Ortíz Ortíz, 31, for robbery with intimidation and injuries; and Bladimir Ezequiel Vivas, 19, for assaults.

The other defendants were identified as Moisés Mendoza Carranza, 32, and Abert Vivas, 36. The Public Ministry asked the judge for a 15-year prison sentence for Mendoza Carranza, and 10 for the others involved in the crime of homicide.

As for the accusations of aggravated robbery and serious injuries to the detriment of the partner of the renowned folklorist, Gustavo Herrera, 52, the Prosecutor’s Office requested seven and five years, respectively. However, the defense of those indicated asked the judge for the minimum sentence for their defendants for the crimes they are accused of.

For stealing a cell phone

On August 15, 2022, Cristian Ruiz Álvarez was drinking liquor near the Monimbó cemetery, together with his partner Gustavo Herrera, when they were intercepted by the five subjects. Herrera assured that the criminals attacked the folklorist with “clubs” until they left him unconscious.

Due to the seriousness of the injuries, the victim required an emergency transfer to the Antonio Lenin Fonseca Hospital in Managua, where 24 hours later he surrendered to death in the Intensive Care Unit (ICU) room.

According to data from the police authorities, the trans woman was violently attacked until she caused severe head and facial trauma, which led to her death as a result of the blows she received with sticks to the head.

Ruíz Álvarez lived in the Bombonaci neighborhood of this city, where he was fired to the rhythm of the marimba and traditional Masaya dances until his last resting place.
