Moreno, defense of the Ochy brothers, explained that Judge Marquínez responded that she had not been notified of the decision of the First Superior Court of Justice, so she decided to continue with the hearing.
Judge Baloisa Marquínez agreed at the end of 30 days to determine whether to call three defendants in the “New Business” case to trial for whom a procedural break had been ordered for not having been notified of the first preliminary hearing held on January 27 past.
These are the brothers David, Daniel and Dina Ochy for whom the judge had ordered a procedural break and held the preliminary hearing this Thursday.
During the hearing, the Public Ministry requested the summons to trial for the three investigated, after presenting the results of the investigation initiated in 2017 for alleged money laundering for the Editora Panamá América (Epasa) through the company New Business.
Roberto Moreno, lawyer for the Ochy brothers, said that in this case, Judge Baloisa Marquínez was warned of the existence of an injunction from the First Court of Justice, through which she was ordered to annul the hearing held last January, after consider that the procedural rupture dictated on that occasion was not duly substantiated.
