The President of Congress, Joseph Williams (Avanza País), ruled on the decision made by the First Constitutional Chamber in admitting the amparo action filed by the defense of President Pedro Castillo against Parliament.
Williams Zapata indicated that this resource would have the objective of distracting citizens from the underlying problems. In that sense, he assured that the Legislative Power is not hindering the work of the Executive.
“I think it’s another issue that aims to distract the population…They are hindering the task of the Executive, but there is nothing of that”, he declared for the press.
Next, the head of Parliament said he did not have full knowledge of the amparo action, but clarified that if it is about powers, the national representation is complying with those established in the Constitution.
“I understand that it is due to powers that the president considers to be his, but it must be taken into account that Congress also has powers established by the Constitution, which have to do with the vacancy process and constitutional complaints. If it is about constitutional complaints, they have been filed by the National Prosecutor’s Office, by citizens and some have been made their own by congressmen”, he expressed.
“If it is about the vacancy, obviously it is our faculty and that is very clear. We have the power to make a vacancy motion due to matters that the congressmen deem convenient.. All this has a corresponding parliamentary process. We follow due process for those instruments”, he added.
Amparo action
The First Constitutional Chamber of the Superior Court of Justice of Lima admitted for processing this appeal presented by the lawyer Ananias Narro Culque and scheduled a hearing to evaluate the case on March 6, 2023 at 9 am, which will be virtually.
This document requests that the processing of the constitutional accusations presented against Castillo Terrones in the Subcommittee on Constitutional Accusations be suspended, as well as the annulment of the third vacancy process due to permanent moral incapacity, which is still in the process of collecting signatures.
