The congressman Second Montalvoof Free Peruformally requested the president of Congress, Fernando Rospigliosiwhich urgently incorporates the vacancy motion against José Jerí on the agenda of Extraordinary Plenary called for this Tuesday, February 17.
The Agenda Motion raises the vacancy of the president for the reason of permanent moral incapacity, contemplated in article 113, paragraph 2, of the Constitution. The document indicates that the initiative was presented in a timely manner and that it meets the regulatory requirements for its debate.

In the letter, Montalvo recalled that he had already sent previous communications on January 21 and 26. Both were referred to the Presidency, Chief Officer’s Office and the Rapporteurship and Agenda Area of the Congressaccording to the documentary monitoring record. And that, despite this, the motion does not yet appear as a confirmed point in the extraordinary session.
The legislator maintained in the document that the presidential vacancy cannot be subject to administrative decisions. He affirmed that the Regulation establishes a mandatory priority for this type of requests and that their treatment does not depend on the political will of the person who requested the call of the Extraordinary Plenary.
Extraordinary Plenary Session of Congress prepares censure debate against José Jerí
He Congress of the Republic set the Extraordinary Plenary for this Tuesday, February 17 with only one point on the agenda: debate the motion of censorship against the president José Jeríafter validating the signatures necessary to admit the request in plenary.
The call was made official by the president in charge of Parliament, Fernando Rospigliosiafter the Senior Officer’s Office confirmed the validity of 79 digital signatures linked to the procedure, which lifted the administrative objections that had prevented the date of the debate from being set.
In his announcement, Rospigliosi acknowledged that the promoters of the motion of censure —who made formal errors in the first version—corrected the document and presented the request divided into seven parts, an unusual format but accepted by the table. The in-person session will start at 10 am in the auditorium of the José Faustino Sánchez Carrión Building.
