José Jerí: If censorship does not succeed, his vacancy will be debated in the first plenary session of March

The head of Congress, Fernando Rospigliosi, reiterated that the only item on the agenda of this Tuesday’s extraordinary plenary session will be the motions of censure against President José Jerí and announced that if a simple majority is not reached for the president’s departure, they will have to wait until the start of the legislature, next March 1, to debate the vacancy motion.

“In the hypothesis that the censure of President Jerí does not succeed, the ordinary legislature begins on March 1 and in the first plenary session held in this ordinary legislature, the first topic will be, as appropriate, as indicated in the regulations, the vacancy motion that has also been presented,” explained Rospigliosi.

The president in charge of the Legislature pointed out that a simple majority of the able congressmen is needed to approve the president’s censure. He explained that if this occurs, the election of a new president of the Legislature who will become president of the republic must be called. This procedure includes the presentation of candidates and the subsequent election of congressmen.

This extraordinary plenary session, whose call was endorsed with the signature of 78 legislators, will be held in person in the auditorium of the José Faustino Sánchez Carrión building, in the Azángaro neighborhood, since conditioning work is being carried out at the Plaza Bolívar headquarters for the bicameral Congress that will begin next July.

Rospigliosi recognized the technical limitations of this location, pointing out that it does not have voting control mechanisms or voting telephones. The press will also not be able to enter the auditorium and televisions will be enabled to follow the session.

President Jerí will not attend this plenary session, since the motions against him are of censure. Although his attendance is not an obligation, the Constitution provides that in the event of a vacancy motion the president can appear personally or send his lawyer to exercise his defense in plenary session.

Until the closing of this edition, according to preliminary calculations by Perú21, the proposals to censure the president would have some 79 votes guaranteed; According to the Internal Regulations of Parliament, its approval requires the vote of “more than half of the legal number of members of Congress.”

It must be remembered, however, that several constitutionalists have indicated that censure is not the way to remove Jerí from the presidency, but rather the vacancy, for which a single motion has been presented, which does not appear on the agenda of tomorrow’s plenary session. Its approval requires 87 votes.
