Infringement. Zoraida Ávalos Rivera, former prosecutor of the Nation, was suspended from her functions as supreme prosecutor in the Public Ministry for a period of 30 days, after the National Board of Justice (JNJ) will hold a hearing on the last December 16 on voting for a disciplinary proceeding against you.
The Board rated as “serious misconduct” on the part of Zoraida Avalos appoint as Piura deputy superior prosecutor Carla Bourdieu Zavala, daughter of her close friend and comadre María Amabilia Zavala Valladareslawyer who also integrates the current Plenary of the JNJ.
Indeed, it was the doctor Ines Tello who exposed Report No. 143-2021-JNJ, in reference to the process opened against Zoraida Avalos for “serious conflict of interest”, by naming the daughter of a “close” person to the ex-owner of the Public ministry.
In the same way, Tello mentioned that this process occurs with the complaint imposed by the citizen Meliton Astucuri Rojas upon learning of a journalistic report called “War for the National Board of Justice”, broadcast on January 12, 2021 in the Sunday newspaper Panorama.
Given this, a preliminary investigation was opened, which gave rise to a disciplinary process in which the defense of Zoraida Ávalos was also heard.
In that sense, the National Board of Justice specified that, although there was no special procedure for the appointment, the investigated “He did not keep impeccable conduct, when designating the daughter of a person with whom he had friendship and godmother ties”.
“I ratify all the extremes of the presentation. Consequently, my vote is for the disciplinary procedure to be concludedand consequently determine the administrative responsibility of the prosecutor Zoraida Avalos for failing in their established duty”, expressed magistrate Inés Tello.
The other members of the Board took the same position: José Ávila Herrera (president), Imelda Tubialán, Guillermo Thornberry, and Antonio de la Haza. Finally, it was determined to grant a sanction of suspension for 30 days to the former prosecutor of the Nation.
