The prosecutor of the Nation Delia Espinoza could be suspended from her functions in the next few days by the National Board of Justice (JNJ). Report No. 46-2025-MTCV-JNJ, signed by Dr. María Teresa Cabrera, imputes Espinoza breach of resolution No. 231-2025-JNJ that replied to Patricia Benavides as Supreme Prosecutor and Prosecutor of the Nation, in addition to having instigated the fiscal and administrative staff of the Public Ministry. The proposal of the report is a precautionary measure of preventive suspension in the exercise of the position of prosecutor of the nation and supreme prosecutor.
The report will rise to the Plenary of the JNJ with the proposal of precautionary measure for the suspension of Delia Espinoza for six months.
The document indicates that this is a “precautionary measure of preventive suspension” that would govern while a disciplinary procedure against Espinoza is processed, who questioned the resolution issued by the JNJ in June, which had the replacement of Patricia Benavides as the Supreme Prosecutor and Fiscal of the Nation.
Espinoza questioned this decision of the JNJ and postponed its fulfillment until August, when Benavides was reincorporated as a supreme prosecutor after a series of institutional and judicial decisions.
The document details that Espinoza “refused to admit and execute the provisions of the National Board of Justice, displaying actions to question the validity and execution of the mandate.”
The JNJ concluded that Espinoza incurred serious and very serious offenses, such as interference in the exercise of functions of other State bodies, disobedance to binding administrative acts and discriminatory treatment in the performance of the fiscal position.
