The National Board of Justice (JNJ) decided to initiate a preliminary investigation against the suspended nation’s attorney, Delia Espinozafor alleged functional misconduct, after it took 57 days to carry out the reinstatement of prosecutor Azucena Inés Solari.
According to the decision, Solari’s reinstatement was issued in June, but was only formalized in August by order of the then head of the Public Ministry.
The complaint was made by Luis Miguel Calla, who maintained that the delay is a failure to fulfill functional duties. Given this, the plenary session of the JNJ determined that the reported facts may constitute very serious offenses, in accordance with sections 6 and 13 of article 47 of the Law of the Fiscal Career.
During the delay in the execution of the reinstatement order, Espinoza would have sent several letters in which she opposed complying with the JNJ resolution, despite having been duly notified. Consequently, this behavior was considered by the JNJ as disciplinary misconduct.
The nation’s suspended prosecutor could face sanctions ranging from suspension to dismissal.
Azucena Solari was dismissed for having supported reports considered inconsistent, which served as support to remove a prosecutor who was investigating Supreme Judge Emma Benavides. However, in June of this year, the National Board of Justice (JNJ) annulled said sanction and ordered his reinstatement to the position of senior prosecutor.
