The National Board of Justice (JNJ) It specified that the complaints, preliminary investigations and disciplinary procedures that they carry out are confidential and that the decisions adopted by that body are justified and duly motivated.
Through a statement, the institution detailed that the investigations related to Disciplinary Procedure No. 137-2021-JNJ, which involves three supreme magistrates, including the president of the Judicial Power (PJ), Elvia Barriosis in charge of an instructor member, who issues the report corresponding to his attributions and does not participate in the final decision.

“The complaints, preliminary investigations and disciplinary procedures carried out by the JNJ, suppose acts of investigation that are reserved and are in charge of an investigating member.who issues the report corresponding to its powers and does not participate in the final decision, as is the case of Report No. 026-2022-GSTV-JNJ, regarding Disciplinary Procedure No. 137-2021-JNJ, which involves three supreme magistrates”, reads the statement.
In this sense, the JNJ reported that the magistrates who are investigated can appear in a public hearing to formulate their defenses, present their arguments, contradict and challenge.
“A speaker member, randomly assigned, then presents a paper that is the subject of deliberation by the plenary, before voting on the cause. The decisions adopted by the JNJ are translated into resolutions duly motivated, justified and arguedbased on fact and law”, he added.

The JNJ recalled that the contents of an instruction report are not binding for its plenary session and do not affect the presumption of legality of the actions for which the magistrates are investigated.
