The Plenary of the National Board of Justice (JNJ) resolved the dismissal of Patricia Benavides Vargaswho served as prosecutor of the Nation, after verifying his responsibility in very serious offenses related to the improper cessation of prosecutor Luis Felipe Zapata Gonzales.
According to Resolution No. 051-2025-PLENO-JNJ, these serious offenses are typified in subsections 1 and 10 of article 47 of the Fiscal Race Law (Law No. 30483).
The seventh article, approved by a majority, details that the removal of Zapata Gonzales lacked due motivation and incurred labor coercion, violating fundamental principles of public function, such as ethics, probity and respect for due process.
The ordinary disciplinary procedure, initiated on January 24, 2024, by the previous Plenary of the JNJ, included the compilation of documentary evidence, testimonies and legal analysis that confirmed the responsibility of the former Nation’s former Nation.
In the fourth article of the document issued on January 22, Liz Patricia Benavides Vargas is unanimously acquitted for his action as prosecutor of the Nation at the end referring to the removal of prosecutor Aurora Remedios Fátima Castillo Fuerman, the processing of the Sánchez case Paredes and the undue cessation of Víctor Manual Cubas Villanueva of the position of Technical Secretary of the Technical Office of Implementation of the New Criminal Procedure Code, since its disciplinary responsibility is not accredited.
In addition, he is acquitted by majority by not having accredited disciplinary responsibility in his status as a prosecutor of the Nation to make changes in the formation of prosecutors that make up the special team for the case “The white necks of the port”. The investigated Liz Patricia Benavides Vargas was notified of this decision.
Finally, in the tenth article, the investigated Enma Rosaura Benavides Vargas is acquitted as a majority for his action as Superior Judge of the Superior Court of Justice of Lima by not proving his disciplinary responsibility.
Dismissed
As is known, Patricia Benavides was dismissed by the JNJ after an administrative procedure that questioned her performance as a prosecutor of the Nation. Since then, the former official has argued that constitutional rights were violated, trying to reverse their dismissal through various legal resources.
For its part, the Judicial Power declared the claim for amparo filed by Benavides, who sought to recover his position as head of the Prosecutor’s Office.
