Jnj blindes Juan Fernandez Jerí and decides not to initiate disciplinary procedure after Rafael Vela's complaint

The National Justice Board (JNJ) The complaint filed by Rafael Vela against the Head of the National Public Prosecutor’s Office (ANC-MP), decided to file, finally filed the complaints filed by Rafael Vela, Juan Fernández Jerí. The resolution dismisses any disciplinary sanction, totaling the official.

The case originated in 2023, when Vela denounced that Fernández Jerí promoted arbitrary procedures against him. He claimed that there were no minimum guarantees of impartiality and requested that the JNJ assume the process directly. Despite this, the collegiate body chose to close the investigation without even opening a procedure.

The decision not only benefits Fernández Jerí, but also six senior officials of the ANC-MP. For the candle environment, this ruling confirms that the JNJ has chosen to align with the control apparatus that seeks to neutralize prosecutors who bother sectors of power, including those who investigate “the white necks of the port”.

With this armor, Fernández Jerí is in a position to use the ANC-MP as an institutional armed arm. The risk is evident: suspend or separate prosecutors such as Vela and José Domingo Pérez, and thereby weaken corruption and organized crime.

Resolution opens the door for Fernández Jerí to act against uncomfortable prosecutors

Jnj’s resolution indicates that there are not enough merits to initiate a disciplinary process. The collegiate argued that Fernández Jerí’s performances occurred within their functions and, therefore, do not configure irregularity. That interpretation is seen by critics as an “institutional shield” to protect it.

The entity also dismissed the orders to review the impartiality of the official, closing the possibility that an independent organ evaluates its behavior. This reinforces the idea that the internal control system is maintained in the hands of those who should be scrutiny.

In this way, a scenario is consolidated where magistrates investigating networks of political and judicial power are exposed to being sanctioned or separated, thus weakening the autonomy of the Public Ministry.
