He National Jury of Elections (JNE) declared the ruling issued by the third Constitutional Court of the Superior Court of Justice of Limawhich ordered the official registration of the political party Popular Unit leading Duberlí Rodríguez with a view to the next general elections of 2026.
Among the JNE arguments it is indicated that the electoral schedule is immodifiable, so that applying the provisions of the Judiciary alters the order established in the electoral guidelines.
“Inejecutable declare the immediate action mandate contained in Resolution No. 1, dated July 31, 2025, issued by the third court specialized in the constitutional of the Superior Court of Justice of Lima, within the framework of the protection process marked with file No. 06374-2025-0-1801-DC-03 Development of the electoral process under conditions of equality for all political organizations, ”says the resolution accessed by the Republic.

They also specify that the court order puts equal conditions between political parties, since the measure intends to perform acts with retroactive effect, which contradicts current regulations.
In that line, from the JNE they indicated that the interpretation of the Court on article 96 of the Organic Law of Elections (LOE) that favors the Popular Unity Political Party is not valid, since said rule has been repealed and replaced by article 10 of the Law of Political Organizations.

The entity led by Roberto Burneo, also reported that in March 2024 he presented a bill to Congress to legally create the figure of provisional registration, an initiative that is still pending debate.
