With this resolution, the JNE ordered the definitive archiving of the file, specifying that its rulings are final and constitute res judicata in the electoral headquarters, in accordance with the Constitution and its Organic Law.
The measure nullifies any possibility that Popular Action present candidates for the Presidency, Congress or other popularly elected positions in the 2026 general elections, as the deadlines of the electoral schedule have expired.
Popular Action is left without candidates after the deadlines of the electoral schedule have expired
In his appeal, Popular Action alleged violations of due process, the principle of legality and the constitutional right to elect and be elected, arguments that were discarded by the JNE.
The referee recalled that article 181 of the Constitution establishes that its decisions are final, while its Organic Law indicates that the rulings of the Plenary Session constitute final res judicata in electoral matters.
The exclusion of the party does not respond only to the nullity of its internal party, but also to the material impossibility of correcting the process, due to the expiration of the deadlines established in the official schedule.
With this resolution, Popular Action is formally out of the race and without representation in the elections 2026in the midst of a deep internal crisis marked by disputes, questions and failures in its party organization.
