The Special Electoral Jury (JEE) of Lima Oeste 1 declared the request for annulment of the elections in the district of Lince to be founded due to serious irregularities in the development of the process and the violation of electoral regulations and fundamental rights of a constitutional nature.
According to Resolution No. 01963-2022-JEE-LIO1/JNEthe logo of the political organization Avanza País was not included in the ballot paper for that jurisdiction, despite the mandate issued by the Fifth Constitutional Court of Lima.
Said instance of the Judicial Power granted a precautionary measure ordering the suspension of a resolution of the JEE of Lima Oeste 1, which had declared inadmissible the request for registration of its list of candidates due to the lack of digital signature of the personero.
The decision was notified to the National Elections Jury (JNE) on September 16, arranging for the registration and publication of the list of candidates of Avanza País for the District Municipal Council of Lince.
Despite what was ordered by the Judiciary and the provisions of this JEE of Lima Oeste 1, this was not complied with by the National Office of Electoral Processes (ONPE)since it is the body in charge of preparing and printing the ballot papers.
For this reason, it states that since Avanza País was not included in the list of candidates “per se” originates a “Distortion in the vote, since voters have been deprived of seeing said candidacy and eventually voting for it”.
For all these arguments, the JEE of Lima Oeste 1 declared founded the request for annulment of elections in the district of Lince, presented by the legal representative of Avanza País, Aldo Fabrizio Borrero Rojas.
Finally, it was arranged to send the resolution to the Decentralized Office of Electoral Processes (ODPE) of Lima Oeste 1, as well as to the ONPE for its information and purposes.
