Janet Tello to Congress: "The Judicial Branch is not an appendix of any political, economic or factual power"

The president of Judiciary, Janet Tello Gilardisent a strong message to Congress of the Republic in the midst of the questions directed at the judges who decided to disapply laws approved by the Parliament through diffuse control, protected by the Constitution. In this context, during the opening ceremony of the 2026 Judicial Year, Tello Gilardi stated that the institution he directs does not act in favor of political interests.

“In safeguarding judicial independence, I must also face the unfair qualifiers that the political power continues to receive from the judges who did not apply the laws that they considered unconstitutional; that is, who fulfilled the duty of carrying out the diffuse control imposed on them by the Political Constitution. (…) The Judiciary is not an appendix of any political, economic or factual power,” he stated.

Likewise, the head of the judicial system will “bravely preserve” its independence and impartiality and that any attempt at judicial disruption will not be tolerated. “Rest assured that judges will never be tools of impunity, nor instruments of persecution.”

Tello’s speech gained greater relevance due to the presence at the ceremony of the President of the Republic, José Jerí; of the head of Congress, Fernando Rospigliosi; and the heads of various institutions, such as Reniec, ONPE, the Constitutional Court and the JNE, among others.

Among the rules that the judges decided to disapply is the Amnesty Law (case Chumbivilcas), which protected immunity for members of the FF. AA. and PNP prosecuted for alleged human rights violations in 1980 and 2000. The Law Against Humanity also appears, which was not used in the cases. On the other hand, Tello indicated that he requested Congress that the Judiciary participate in the process of any constitutional reform that is intended to be promoted. In that sense, the president of the PJ explained that they have sent their opinions and proposals to the Special High-Level Multiparty Commission, in charge of evaluating the modification of various articles of the Constitution related to the Judiciary, especially with regard to the use of diffuse control.

“No constitutional or legal reform can validly affect the autonomy or independence of the Judiciary, nor weaken the jurisdictional protection of people,” he said.

Janet Tello: “No public office is above the law”

In his 2025 balance sheet, Telló detailed that complex sentences were issued. Among them, the Supreme Court issued 235 sentences of 35 years in prison, 269 of 30 years in prison, 168 of 25 years and 508 life sentences.

“The Judiciary has issued important rulings and, in many cases, of significance for the country that send a clear message: no public office, economic power or criminal organization is above the law,” he asserted.

Electoral justice

On the other hand, the president of the Judiciary indicated that at the beginning of 2025, an interinstitutional agreement was signed with the National Election Jury (JNE) with the purpose of facilitating access to the criminal records of the candidates for the presidency of the Republic and the Congress.

In that sense, the digitalization plan of the national registry of convicted women was implemented, in which more than 944,854 physical bulletins of criminal convictions were registered.

“This will allow us to respond to requests for information about the 4,264 applicants that the JNE will make within the framework of the electoral process,” he explained.
