The lawyer Laura Acosta has denounced that during the trespass to the home of Beras, last Wednesday night in the National District, his arrest took place and the Public Ministry prevented him from being assisted by defenders in violation of Criminal Procedure Code.
“He Procedural Code Penal Law establishes that when at the time of the arrest a violation of the law occurs, the immediate freedom“I’m not saying it, the law says it,” Acosta said.
He even indicated that in the arrest order to which he “had access two days later,” the judge who authorized the arrest emphasized compliance with the due process.
“Article 3 of the arrest order, I read, the judge orders ‘that at the time of the arrest of the citizens subject to this order, they be made aware of all their rights, including the right to be assisted from the moment their arrest occurs. detention by a lawyer of his choice, who must necessarily be present during the interrogation of the arrested person, right to call among others provided by law,'” he cited.
Acosta confirmed that as lawyer I shouldn’t have been in it trespassbut that it was his responsibility to assist the former director of the Intrant since his arrest occurred.
He noted that his client can follow the process judicial in freedom.
On his side, the lawyer Luis Rivas, also of the defense of Beras, criticized the procedure of the Public Ministry to carry out raids at night and that judges favor it when this is an exceptional schedule, which must be motivated.
“The judges they have to put a stop to the Public Ministry telling him: ‘justify me’, how is it possible that I have been investigating a person for a year and in a year you decide to go raid him at night, where is the urgency that justifies the trespass is done exceptionally, that is an abnormal situation,” he deplored.
The lawyers emphasized that Beras does not represent a flight risk.
In the arrest warrant issued by Judge Fátima Scarlette Véloz Suárez, the Public Ministry points to Beras for corruption and other crimes in the contract signed during its management with the company Transcore Latam for the management of the traffic light network of Greater Santo Domingo.
The lawyers indicated that throughout this year of the scandal of Intranthe Public Ministry never questioned Hugo Berasunlike Jochi Gomezco-accused in the same incident, who since last Wednesday has been interrogated thrice.
The deadline for the Public Ministry to deposit the file requesting a measure of coercion expires this Friday at 8:07 pm, taking into account the time at which Jochi Gómez, the first of the detainees, was placed under arrest.
