Inter-American Court: Peru must refrain from implementing the ruling of the TC that restores pardon to Alberto Fujimori

The (IA Court) ordered the not abide by the ruling of the Constitutional Court in favor of be released upon reinstatement of his pardon. This means that the former president will remain in prison, serving his sentences for crimes in the Barrios Altos and La Cantuta cases, among others.

Through a document on the request for temporary measures and supervision of compliance with the sentences for the cases of Barrios Altos and La Cantuta, the institution resolved on five points.

The first is related to the specific supervision related to the pardon of former President Alberto Fujimori for “humanitarian reasons”, through the supervision of compliance with the obligations to investigate, prosecute and punish human rights violations in the aforementioned cases.

The second point is where it is mentioned that the Peruvian State should refrain from implementing the ruling issued by the Constitutional Court on March 17, 2022, since the pardon for “humanitarian reasons” does not meet the conditions determined in the Supervisory Resolution of compliance with judgments of May 30, 2018.

“Require the State of Peru to submit to the Inter-American Court of Human Rights, no later than May 13, 2022, a report on compliance with the obligation to investigate, prosecute and punish in relation to not executing the sentence handed down by the Constitutional Court of Peru on March 17, 2022, which restores the effects of the pardon “for humanitarian reasons” granted to Alberto Fujimori Fujimori on December 24, 2017″, the document further states.

Likewise, the Inter-American Court ordered that the representatives of the victims submit their observations to the requested report within a period of four and six weeks, counted from the notification of said report.

“Order that the Secretariat of the Court notify this Resolution to the State, the representatives of the victims and the Inter-American Commission on Human Rights”, indicates the fifth and last point of the resolution.
