Inspector of the MP imputes “serious” faults to prosecutors

The Inspector General of the Public Ministry, John Medinayesterday requested the suspension of the supervisor of San Francisco de Macorís Engels Polanco Henriquezand of the court attorney of Montecristi, Antonio Báez Tapia, for allegedly incurring in “serious” and “very serious” offenses in the exercise of their functions.

In a communication addressed to the Superior Council of the Public Ministry (CSMP), which is chaired by the Attorney General Miriam German Britoquestions to Polanco Henriquez for accepting that Eusebio Rosario Hernandez (Eddy)accused together with a minor son, of the death of Carmen Paulino Gabriel (Rafeline)preventive detention will be varied for an economic guarantee, disregarding article 241 of the Code of Criminal Procedure.

He added that, however, on the 18th of this month “his criteria changed due to the knowledge of a review of the informal coercion measure, in which budgets were not presented that guaranteed the presence of the accused to the other acts of the process.”

Inspector Medina de los Santos also points out that the case did not fall under article 241 ofl Code of Criminal Procedure, about the termination of pre-trial detention.

In this regard, he indicated that the 12-month period for preventive detention had not expired, but was due on June 7, “so it is not justified for the prosecutor to request the variation of the measure of coercion, due to the expiration of a period that had not yet expired, especially in a case as serious as the one at hand.”

Regarding attorney Báez Tapia, it indicates that he incurred in violation of the Organic Law of the MP133-11, by “neglecting the file and the process followed against former prosecutor Carmen Lisset Núñez”, accused together with four DNCD agents of “planting drugs” in a barbershop, in favor of whom the charges were withdrawn.
