INE orders to remove AMLO's morning paper from March 7 for containing illegal propaganda

The Complaints and Reports Commission of the National Electoral Institute (INE) set two precautionary measures to the Presidency of the Republic for broadcasting illegal government propaganda during the ongoing process of revoking the mandate of the president Andres Manuel Lopez Obrador for loss of confidence as established by the Constitution.

By unanimous vote of the directors claudia zavala, Cyrus Murayama and Adriana Favela Herrerathe Complaints and Denunciations Commission declared appropriate precautionary measures against the President of the Republic for the dissemination of two publications on March 5 and 6 on his Facebook account, for being government propaganda, as well as for the dissemination of actions and government achievements during the morning conference on March 7, which was attended by the director of Mexican oil (Pemex), Octavio Romeroand the head of the Ministry of Agriculture and Rural Development, Victor Villalobos.

The directors that make up said Commission estimated that both the posts on Facebook of the President of the Republic as well as by the manifestations of the director of Pemex and the secretary of Agriculture in the morning conference deal with government propaganda related to the achievements of the federal government.

For this reason, it was ordered Republic President to immediately, within a period that may not exceed 6 hours, take the necessary steps to eliminate the audio, audiovisual files or stenographic versions of the morning conference held on March 7 or modify the aforementioned files so that the demonstrations carried out by the aforementioned officials be suppressed.

In the same way, it was ordered to remove the publications made on March 5 and 6 on Facebook and any other electronic platform under the domain, control or administration of the Presidency of the Republic and its spokesperson, and must report its compliance, within the 6 hours after that happens.

Regarding the request to issue preventive protection, the Commission considered its inadmissibility, since the request deals with future events of uncertain realization, since there are no elements or data in the file that serve as a basis to consider that the acts denounced will continue or will be repeated, without prejudging the existence of the reported infractions, which, if applicable, will be analyzed by the Specialized Regional Chamber of the Electoral Court of the Judicial Power of the Federation (TEPJF), when it resolves the merits of the matter.

Meanwhile, in another matter, the Complaints and Denunciations Commission determined that the self-proclaimed “Youth of Morena State of Mexico” and the newspaper “Regeneration”both linked to Brunette, do not intervene illegally in the revocation of mandate.

The Commission declared inadmissible the precautionary measure requested by the PAN and PRD against Morena and its national leader Mario Slimfor the alleged promotion and illegal intervention in the mandate revocation process, for the holding of various events and brigades “Juventudes de Morena Estado de México”, which promote this exercise, among them, the so-called “Municipalist Meeting of Morena” , held on March 6, where Delgado even asked to visit house by house to achieve a historic participation and win the continuity of the self-styled 4T.

The Commission also declared the precautionary measure inadmissible regarding the distribution of the newspaper called “Regeneration”, because it is not part of the partisan structure, in addition to the fact that the Morena party distanced itself from the publications.

However, the Commission called on the president of the Morena political party to, at all times, adjust his actions and conduct to the constitutional limits and parameters regarding revocation of mandate, and reminded him of his obligation to conduct himself with impartiality and neutrality. in order not to influence, in any way, the public opinion.

In a third case, the Commission denied precautionary measures requested by Morena against Marko Antonio Cortesnational president of the PAN, for the alleged violation of the principles of legality, impartiality, and equity in the revocation process, because the PAN leader attended events where he made statements with the intention of inhibiting and discouraging the participation of the citizenship.

The Commission preliminarily considered that they were acts of consummation, since the events were held on October 12, 2021 and February 4 and 21, 2022; Similarly, it denied the preventive protection requested because there is no objective and sufficient information to infer that these behaviors will occur in the future.

However, the Commission also called on the president of the PAN, so that, at all times, he adjusts his acts and behaviors to the constitutional limits and parameters in terms of revocation of mandate, and reminded him of his obligation to conduct himself with impartiality and neutrality in order not to influence, in any way, the public opinion.
