The National Electoral Institute (INE) published in the Official Journal of the Federation the manual of perceptions of its personnel that will govern during 2022, in which it highlights that the gross monthly salary of the electoral advisers will be 262 thousand 634 pesos, which, discounting taxes, will amount to 179 thousand net pesos, with the exception of the adviser Martín Faz, who since his arrival at the institute requested to earn less than the President of the Republic, as established by the current legal framework.
The remuneration of the directors substantially exceeds the salary of President Andrés Manuel López Obrador, who receives 162 thousand pesos gross and 112 thousand net, from the reduction that was determined at the beginning of the six-year term and whose litigation before the Supreme Court of Justice of the The Nation has not yet been resolved in the background, so every year, the autonomous organizations have litigated wages before that instance.
The document was published in compliance with the Federal Budget and Treasury Responsibility Law, which establishes in its article 66 that the autonomous entities, through their respective administration units, will issue their remuneration manuals, including the tabulator and the corresponding rules. The list reflects profound differences, given that the lowest salary of workers at the INE is 12,685 pesos per month, which contrasts with the salaries of directors and officials in the executive area.
In the breakdown of salaries, the INE reports that in terms of pay, the total item is around 9 thousand 400 million pesos for all base personnel and fees. In the salary breakdown, in reference to the income of directors, it is established that they are made up of 49 thousand 34 as base remuneration and 213 thousand 600 as guaranteed compensation. The document mentions that there is an item of 4.9 million pesos destined for year-end compensation for the 11 directors, with which, with the exception of Faz, they will have a bonus of 449 thousand pesos.
Even with the aftermath of the disagreement with the government over the budget adjustment and the refusal to expand the budget for the body to organize the revocation of the mandate, the INE justifies the reasons why there are salaries above what the President earns (not only electoral advisers, but also of the senior officials of the executive area with incomes between 240,000 and 254,000 pesos per month).
In attention to the sovereignty of the powers and the autonomy of the autonomous constitutional bodies, the constitutional norm establishes as a parameter the remuneration of the head of the Executive Power, but this is a mere reference, which in no way places it in a hierarchical position with respect to the other powers nor of the autonomous constitutional bodies, but it is the basis on which the remunerations must be set and that the Supreme Norm recognizes that there must be proportionality between the remunerations and the functions and responsibilities inherent to the position.
For the INE, the reform that modified the salary structure in the federal public administration incorporates provisions that explain salaries: “although article 127 of the Constitution establishes as a limit to the remuneration of public servants the maximum limit of what the President receives (… ) the constitutional provision also provides for an “exceptional legal regime” that determines that the surplus is a consequence of the performance of various public jobs, or that the remuneration is a product of the general working conditions, derived from a qualified technical job or due to specialization in its field. function.
