MIAMI, United States. – Independent lawyer Julio Ferrer Tamayo asked to the highest authorities of Cuban Television to remove the pro-government presenter Humberto López from the Noticiero Estelar and other programs where he appears.
“The highest authorities of Cuban Television, especially those of the Informative System, should not continue to give journalist Humberto López the space of the Cubavisión Star Newscast, so that he can use that means of mass dissemination in the materialization of his obviously careerist purposes,” he wrote. Ferrer Tamayo on Facebook.
“I consider it useful to remind those authorities that the media and journalists cannot make value judgments. When it comes to news related to a criminal act, they should be limited exclusively to the fact, ”he added.
“They cannot ensure that a defendant or defendant is guilty if a conviction has not been issued against him and that it has become final. They must not name the defendant or defendant as a murderer, rapist, aberrated, indecent, unscrupulous, vandal. Unfortunately, many political and government authorities have also incurred in this, including the president of the nation,” lamented the lawyer.
“If a journalist incurs in acts such as those I have indicated, during the exercise of his profession, he unquestionably violates the principle of the presumption of innocence and the human right to honor of that person, who until then must be considered innocent. In addition, it negatively influences a criminal proceeding in progress when what is known as a ‘parallel trial’ occurs, which violates due process”.
“Journalists have no judging power, a power that Humberto López has abrogated to predict the outcome of a legal process that is underway or that could be launched in the future.”
Ferrer Tamayo also regretted that López is presenting filmed audiovisuals to people who are subject to a certain criminal process. “It is worth asking: Under what legal precept do these authorities provide Humberto López with these audiovisual materials so that he can make them public and broadcast them through Cuban Television?” he asked himself.
Last weekend, Lopez used his segment on the National Television Newscast to present a photo of weapons confiscated during the Balkan War as evidence of terrorist activities planned on Cuban soil by exiles from the Island.
In this way, the spokesman for the Cuban regime has not only shown several videos where young people who protested against the regime in Nuevitas, Camagüey, incriminate themselves; but he has used false photos to misinform and intimidate Cubans.
Shortly before, also threatened people who express their discontent in the streets. López assured that those who protest in a disorganized way on public roads will have to answer in court for participating in alleged crimes of public disorder.
