Lima, Peru – Cuban mother Maylen Díaz Delgado denounced the lack of rigor on the part of the Cuban regime prosecution by allowing her daughter Brenda, also her aggressor, to recover parental rights after a sentence that only imposed three years of restriction.

Díaz Delgado shows his disagreement that the aggressor, after fulfilling a 4 -year sentence of deprivation of liberty due to continued sexual abuse, could recover rights over his daughter, which represents a risk for his well -being and integrity.

“It is also demonstrated before the world and among the Cubans themselves, how broken, how unusable, how dysfunctional are our institutions and our government itself,” he said in his complaint.

The Cuban mother, exiled in the US and manifest of the 11J, ensures that the sentence is incompatible with the Code of the Family and the Constitution of Cuba, which stipulate that any convicted of sexual crimes against a minor must lose parental responsibility in a permanent and definitive way.

On the subject, Ogat remembers that Maylen has faced obstacles in his struggle for justice, as delays in obtaining medical evidence and difficulties in hiring lawyers.

“From his exile, he has played doors inside and outside Cuba in search of an adequate legal solution,” says the observatory.

Díaz Delgado has not focused his efforts on questioning the criminal sanction, the deprivation of liberty, which in his opinion is absurd, but in challenging the future parental rights of his daughter’s aggressor.

The young mother emphasizes that in any case it could be absolutely questionable these four years for someone who abused a child. “Especially in a society where there are people who are charging sentences of seven years for a simple Facebook post,” he adds.

The Cuban government has also violated the International Convention on the Rights of the Child, Alert Díaz Delgado.

“He has violated the Pact of Civil and Political Rights of which he is a member since 2008, that is, he has violated not only laws within the national territory, but all international agreements and all the speeches that Cuba has issued in different international podiums. A mockery absolutely,” he says.

In this regard, the feminist platform I do believe you Cuba (YSTCC) informed Cuban families about the clarity of national and international laws that protect minor victims from sexual abuse, and that must be strictly complied with.

On Facebook, Ogat and YSTCC gathered the main legislation still in force on the island, as a resource in situations of vulnerability of rights such as Maylen Díaz Delgado and his daughter Brenda.

“The Criminal Code (art. 43) establishes that the deprivation of parental responsibility must be permanent to protect minors from future risks.”

“The Family Code (arts. 190 and 191) reaffirms it, determining the definitive loss of parental rights when serious crimes are committed as sexual abuse.”

“In addition, the Constitution of Cuba (art. 86) establishes that the best interests of the child must prevail in all judicial decisions.”
