Indecopi: Bell's Panettone may be re-sold if it is proven that it does not contain trans fats

announced on Tuesday that the companies together with Supermercados Peruanos SA they will be able to re-commercialize Bimbolete Marmoleado and only if they prove that they do not contain trans fats or do not exceed the established limits.

The Consumer Protection Commission N ° 3 (CC3) of Indecopi decided, by majority vote, to vary the precautionary measures that ordered the cessation of distribution and marketing of Bimbo and Bell’s brand products for allegedly having exceeded the limit of allowed trans fat content.

Therefore, as of this date, Panificadora Bimbo del Perú Sociedad Anónima, manufacturer of Bimbolete Marmoleado, must progressively prove to the CC3, through test reports from external laboratories, that the products that it wishes to make available to consumers are not contain trans fats or, if they contain them, that do not exceed the limits allowed by Supreme Decree No. 033-2016-SA of the Ministry of Health.

The same must comply with Orindale Properties Peru SAC and Supermercados Peruanos SA, manufacturers of panettone with raisins and candied fruits.

The measure is announced a day after the institution also allowed the marketing of Cheese Tris under the same conditions.

The laboratory test tests must be carried out with standardized methods for representative samples for each lot.

According to Indecopi, the majority decision made through Resolutions 001-2022 / CC3 and 002-2022 / CC3 dated January 4, 2022, does not mean a setback or rectification by CC3, since the precautionary measures are maintained , but with variations, taking care to safeguard the rights of consumers.

Likewise, the administrative sanctioning procedures initiated against Panificadora Bimbo del Perú Sociedad Anónima, Orindale Properties Perú SAC and Supermercados Peruanos SA are in process and will subsequently determine the responsibility or not of the supplier.

The variation of the precautionary measures occurred after requests submitted by the companies on December 21, 29 and 30, 2021 in the case of Panificadora Bimbo del Perú Sociedad Anónima and on December 22 and 27, 2021 in the case of Supermercados Peruanos SA , as well as by new test reports provided that would show that the aforementioned products would not contain trans fats above the limits.
