As explained from the Ministry of Justice, “Transportation assistance is a benefit in favor of employees who earn up to 2 minimum monthly salaries, whose purpose is to help them with transportation costs from home to the work site. This being so, there are ways to request the recognition of this right and even the payment of damages.”

Who does not receive transportation assistance?

From the Ministry of Justice it was announced that not all workers receive the transportation assistance. This benefit applies exclusively to those who meet the following conditions:

  • Earn up to twice the current legal minimum wage (SMMLV), that is, a maximum of $2,847,000 per month.
  • Not having service transportation supplied by the employer.
  • Have the need to use public transportation to travel to the workplace.

This means that the people who received a salary increase for 2025 and their salary is over $2,847,000, they will not have the transportation assistance. In addition, those who work from home, work in companies that provide transportation or live a short distance from the workplace are not eligible to receive this assistance.

Likewise, MinJusticia explains that “when the total accrued exceeds two minimum wages, transportation assistance must be paid only if the excess of two minimum wages is due to the payment of overtime, Sunday work or holiday work.”

This means that the only way in which workers receive this transportation assistance If they receive more than 2 minimum wages it is in the case that the $2,847,000 are given for the payment of overtime, Sunday and holidays.
