By order of the National Institute of Transparency, Access to Information and Data Protection (INAI), Mexican Food Security (Segalmex)-Diconsa must deliver the contracts awarded to Gainmate Comedores Industriales, a supplier that has been linked to a network of designated companies of having committed irregularities in contracts with the agency during the administration of Ignacio Ovalle.
Segalmex-Diconsa, where the Superior Audit of the Federation (ASF) and the Secretariat of Public Function (SFP) have found probable irregularities for more than 10 billion pesos during Ovalle’s management, reserved the information for five years with the argument that it is part of a judicial investigation, but the INAI resolved that it should make it transparent.
When presenting the case to the INAI plenary session, Commissioner Norma Julieta del Río pointed out that an individual requested from Segalmex-Diconsa all the contracts or agreements entered into with Gainmate Comedores Industriales since January 2019 and requested that the complementary legal instruments of the contracts be attached. and the documentation that would account for compliance with them.
Segalmex-Diconsa responded that its transparency committee confirmed the confidentiality of the information for five years, because it was contained in an investigation of facts that possibly constitute a crime.
The applicant challenged the classification and requested the intervention of the INAI.
The INAI determined, among other points, that the individual requested to obtain the documents related to the transparency obligations of Segalmex-Diconsa and that these contracts must be in the National Transparency Platform, for which reason it revoked Diconsa’s response and instructed it to provide a public version of the documentation it intended to reserve.
You must also deliver the annex to each of the contracts or agreements contained in the legal instrument, as well as those documents that account for the agreed works that have been fulfilled.
