This evaluation is carried out by a professional team from Inacif, who must determine the patient’s mental state and make a recommendation to the authorities.
If it is determined that she really suffers from schizophrenia and that she committed the act during a crisis generated by that situation, she could be declared not responsible and ordered to be treated by specialists.
The inability to be held accountable for mentally ill persons is provided for in articles 374, 375, 376 and 64 of the Criminal Procedure Code. His lawyer, Juan Concepción, claims that his client has suffered from schizophrenia for eleven years.

According to police, García Cuello decapitated her 6-year-old daughter in the presence of her 8-year-old son and after committing the act, she called her husband to tell him that a problem had occurred.

García Cuello, 44, is a military doctor, devoted to Christian beliefs, serving as a first lieutenant in the Dominican Republic Army.
The indictment states that after the incident, the alleged murderer went to her neighbor for “help,” claiming that an unknown man had entered her home and assaulted her daughter.
