(In) justice in Cuba: with premeditation and treachery

LAS TUNAS, Cuba. — While hundreds of protesters on July 11 and 12, 2021, for expressing themselves as usually happens in civilized countries, have been punished with imprisonment and loss of civil rights — accused of crimes against public order, against the authorities and its agents, or sedition, meaning all those supposed infractions committed against the powers of the State—it would seem as if in Cuba crimes against life had entered a phase of permissibility.

I say this because if the recent deaths of a dozen children at the Diez de Octubre Gynecology and Obstetric Hospital (Havana) caused shock, no less shock is caused by collusion or apathy in their criminal resolution a note from the Ministry of Public Health (MINSAP) ), released on February 6 in Cubadebate.

Only the opinions of the readers in the comments of the publication should make the Attorney General of the Republic, the President of the Supreme Court and the Minister of Justice, and, of course, the main bosses, meditate on their suitability in their respective positions. of the Communist Party of Cuba (PCC), since they are, according to the Constitution, “the superior leading political force of society and the State.”

In this regard, it is very useful to ask: What are the policies of the PCC regarding Cuban society and the State that, while the construction of hotels for international tourism does not stop, hospitals are mere filth, where medical, paramedical and Do you lack the essentials to do your job? Is justice in Cuba in a time of grace for some and punishment for others?

The MINSAP statement says that the deaths of the babies occurred as a consequence of a septic outbreak in which six of the 10 deceased children had sepsis, while the remaining four deaths occurred from other causes, but meaning that the infectious outbreak was linked to ” violations of hygienic-sanitary measures”, which were added to “problems of securing resources that the center presented at that time” and implied “affects on the quality of patient care processes”.

The text adds that as a result of these violations, which deprived the lives of 10 recently born human beings, the authorities imposed 22 administrative measures on 19 management cadres of different levels, as well as three officials and hospital workers.

Allow me to remind you that, unlike murder, qualified by concurrent circumstances —premeditation, treachery, cruelty and many others—, in the crime of homicide, regardless of whether they wanted it or not, anyone “who kills another” qualifies. And remember that crimes are committed by action or omission, that is to say, by doing or not doing. That doing or not doing can be intentional, which is when the person involved in a crime wants or seeks the criminal result, or when he inadvertently anticipates that it will occur, but still assumes the risk.

On the contrary, the crime is committed recklessly when the person involved anticipates that with his action or omission he will cause damage, a danger, a crime, but even so, he continues lightly, hoping to avoid the problem, or when without anticipating the consequences, which should have been foreseen for human reasons, profession, trade or any other order or commitment, is involved in a crime, typified, punishable by law.

The doctors told the parents “your children are dying because there are no medicines in this hospital, complain”! They did it? And the PCC commissioners, all headed by Miguel Díaz-Canel, who go through the fields, urging people to plant sweet potatoes… What did they do so that the children did not die as they did en masse in this hospital in Havana? These are just two questions in a criminal universe where, more than people, it is the communist system that, with premeditation and treachery, makes Cubans victims and perpetrators, attacking all of them, themselves.
