Former Rio de Janeiro state deputy Thiego Raimundo dos Santos Silva, known as TH Joias, is already in the Papuda maximum security prison, in Brasília, where he was transferred on Tuesday night (16). 
He boarded a Federal Police plane at Galeão Air Base to comply with the Differentiated Disciplinary Regime (RDD), as determined by the Minister of the Federal Supreme Court, Alexandre de Moraes.
The transfer was requested by the Federal Police and the Attorney General’s Office and determined by the Supreme Court in the same action that arrested judge Macário Ramos Júdice Netowhich occurs following of the arrest of former president of the Legislative Assembly Rodrigo Bacelar.
The PF stated in its representation that other people under investigation arrested in the same action have already been sent to federal prisons, and that “there is an obvious contradiction”, since there was no inclusion of Th Joias, classified as “one of the group’s leaders and an integral part of its political core”.
Disciplinary sanction
The RDD is a disciplinary sanction applied to prisoners who commit serious misconduct or represent a high risk. Although the prisoner maintains his original regime (generally closed), the RDD rules impose more severe isolation.
Under the differentiated regime, the prisoner remains in an individual cell for a maximum period of 2 years, which can be renewed in the event of a new serious offense. Visits are fortnightly, with only two people at a time, lasting 2 hours and without physical contact.
Sunbathing is limited to 2 hours per day. Furthermore, all visits and communications are recorded and monitored.
The regime can be applied to both convicted prisoners and provisional prisoners (who have not yet been tried) who commit intentional crimes that subvert internal order or discipline, or when there is evidence of leadership in criminal organizations.
TH Joias was detained at the Laércio da Costa Pellegrino Penitentiary, in the Gericinó Penitentiary Complex, in Bangu, in the west zone of Rio de Janeiro since September this year, when he was arrested in Operation Zargun.
Operation
On September 3 of this year, TH Joias and 14 other people were arrested during Operation Zargun, carried out by the PF and Rio Public Ministry (MPRJ). The former state deputy was arrested in a luxury condominium, in Barra da Tijuca, southwest of the city.
On the same day, the parliamentarian was removed from his position at Alerj. TH Joias was a jeweler and, before entering politics, he manufactured gold pieces studded with diamonds for football players and artists.
He was indicted for the crimes of criminal organization, interstate trafficking of weapons and drugs, active corruption, money laundering, smuggling, clandestine exploitation of telecommunications, currency evasion, violation of professional secrecy and embarrassment to the investigation of a criminal organization.
