MADRID, Spain.- The Inter-American Commission on Human Rights (IACHR) granted precautionary measures of protection in favor of the Cuban political prisoner Luis Robles Elizástegui, “after considering that he is currently deprived of liberty in a serious and urgent situation of risk of irreparable damage to his rights in Cuba.”
Through Resolution 41 of 2022, the IACHR states that Robles Elizástegui has been deprived of liberty since December 2020, and would be in severe detention conditions without receiving medical care to date.

The Commission exposes In addition, his relatives and lawyer alleged difficulties in maintaining contact, making visits, and obtaining information about his detention and health conditions; as well as denouncing that Luis Robles has been the victim of aggression by prison officials.
After exposing this situation, the Inter-American Commission on Human Rights requested the Cuban Government to adopt the necessary measures to protect the rights of his life, personal integrity and health; as well as to ensure that their detention conditions are compatible with applicable international standards on the matter.
The organization also demanded that he be given medical attention based on what the specialist doctors prescribe and that he be allowed regular visits from relatives and legal representation.
The IACHR, the main and autonomous body of the Organization of American States (OAS), also requested that the regime report on the actions taken to investigate the alleged facts that gave rise to the adoption of this precautionary measure and thus avoid its repetition.
“The granting of the precautionary measure and its adoption by the State do not constitute prejudgment of a possible petition before the inter-American system in which violations of the rights protected in the American Convention and other applicable instruments are alleged,” the document concludes.
On December 4, 2020, Luis Robles Elizástigui protested peacefully on San Rafael Boulevard with a banner calling for freedom and an end to the repression, in addition to the release of the protesting rapper Denis Solís, who was imprisoned at the time.
