The decision of the Second Criminal Chamber of the Supreme Court of Justice (SCJ) to declare deputy Gregorio Domínguez innocent did not come as a surprise to Lucila Nelly Capellán Luna, who accuses him of authorizing the eviction and demolition of her home in the Punta Rucia community. from Puerto Plata.

“It was already rumored that they were going to blame Domínguez’s employees for him to continue his political career, but God willing, he will not do so,” the lady said this Monday after the court ruled that the legislator is acquitted of the accusation.

Capellán Luna maintained that she feels “a little disappointed in the Justice because it was shown that a house was demolished, who gave the order and I do not think this is the just sentence.”

He stressed that the country is developing in terms of laws, but said that a little more justice is needed.

Lawyer Amadeo Peralta, legal representative of Mrs. Capellán Luna, stated that they are going to study the court’s decision to later determine if they will appeal.

While the legislator for Santiago of the Modern Revolutionary Party (PRM), he only limited himself to expressing that the court did justice.

Valentín Medrano, a member of Gregorio Domínguez’s defense bar, said that it was shown that his client was not at the scene of the events and that he cannot be tried for a crime committed by one of his employees.

According to two of the three judges of the court, presided over by Francisco Jerez Mena, the Public Ministry did not demonstrate during the process that the accused participated and ordered the eviction of the property of Mrs. Lucila Nelly Capellán Luna.

The file presented by the Public Ministry indicates that around 10:00 in the morning of May 27, 2020, Messrs. Basilio Catalino Martínez (Jaime) and Emmanuel de Jesús Williams Molina, employee of the first legislator and driver of the backhoe the second, by instructions of the accused, they went to the Punta Rucia community, in Estero Hondo, where the victim Capellán Luna was building his home.

It explains that once at the scene, Catalino Martínez and Williams Molina proceeded, without the due formalities of the law and by order and with the participation of the accused, to evict, destroy and later demolish the house built by the victim, which was under construction at roof level.
