«I do not dance in court»: Colombian judge Marienela Cabrera defends his videos in Tiktok

The criminal judge of the Circuit of Florence (Caquetá), Mariela Cabrera Mosquerais located in the center of a national controversy after the opening of a disciplinary process against him by the National Judicial Discipline. The investigation was motivated by several videos published in his Tiktok account, in which he appears dancing and performing actions at his home. According to the complainants, these publications would affect the image of the judicial branch and the decorum that a judge must keep.

Among the accusations made to Cabrera Mosquera are the use of clothing considered “inappropriate”, as well as alleged suggestive behaviors in the videos. In addition, it has been questioned whether its activity in social networks interferes with its duties as a judicial officer. As part of the process, an inspection of his cell phone was ordered, which was rejected by the judge when considering that he would violate his right to privacy.

“Judge Marienela, in her social account of Tiktok, which is a personal account, but from public knowledge, makes videos suggestively showing her body, which threatens the decorum and morality of the profession. To the point of boast work ”, was the formal complaint that was brought against him.

What the judge said about the opening of the investigation

The 47 -year -old judge and the mother of three children, has publicly responded to criticism and has defended her right to express themselves freely on social networks. He assures that the videos are recorded outside working hours and within their home, without affecting the normal development of their functions. He has also argued that his professional performance has been efficient, with indicators that support his judicial management.

“I do not dance in court. I don’t have videos in my judicial office. These videos, which all have the same background, are in my house. It is the study of my house,” he said in an interview with Blu Radio.

He said that his videos began in Pandemia, in mid -2020 thanks to his 26 -year -old daughter, a lawyer also, who was the person who announced that profile, who was private and then changed for some reason: “He became public and without thinking.”

“It’s my first complaint, my first disciplinary process”Cabrera mentioned and added that his videos are not during working hours.

On the other hand, Cabrera denounced that during an audience she underwent an excessive and invasive interrogation by magistrate Manuel Enrique Flórez, who questioned for almost three hours a witness who only worked five days with her, focusing on personal aspects such as visits to her home and themes outside her work. In addition, the judge rejected an inspection order to her cell phone, arguing that this measure violates her intimacy.
