The lawyer Humberto Abanto announced that this Monday will file a constitutional complaint against Congress against The Prosecutor of the Nation, Delia Espinozawhom he accuses of incurring the crimes of abuse of authority and prevaricate. According to Abanto, Espinoza would have breached resolutions of the National Justice Board (JNJ) and the Supreme Court that orders Patricia Benavides as a supreme prosecutor.
“On Monday, Mrs. Delia Espinoza will have a constitutional complaint of mine for abuse of authority and prevaricate (…) does so with the sole purpose of accusing defense, uses the public power to harm the people she wants,” he said for Channel N.
In addition, Abanto said that the current head of the Public Ministry has acted for “personal quarrels” and denounced that a fiscal folder was unduly divided to derive part of the case to a provincial prosecutor’s office, which qualifies as an act of harassment against the defense of Benavides.
Meanwhile, this denunciation of Abanto will seek that the Parliament investigate and eventually sanction Espinoza. It should be remembered that Benavides was separated from his position in the middle of a scandal that involved alleged acts of obstacles against his close environment, as well as decisions questioned in high profile cases. The proceedings of the Prosecutor’s Office and the JNJ suggest that they would have used their position to protect already political interests.

Jnj insists on Congress to replace Patricia Benavides
The National Board of Justice (JNJ) sent a trade to the President of Congress, José Enrique Jerí, in which the “repeated breach” of The Prosecutor of the Nation, by Delia Espinozaregarding its June 12 resolution that orders Patricia Benavides as Supreme Prosecutor. According to the document, the prosecution’s conduct represents an omission “flagrant and unjustified”, which damages the principle of authority and generates institutional instability.
The JNJ reaffirms that Benavides has already completed the 60 days of suspension and there is no legal basis to continue preventing its return. The body warns that continuing to expand its reinstatement could aggravate legal insecurity and weaken constitutional control over the fiscal career.
