House approves bill that typifies crime in exchange for sexual activity

Chamber approves extension of subsidies for hydroelectric plants

O Bill 4534/21, which typifies the crime of abuse of power in exchange for sexual activity, was approved by the plenary of the Chamber of Deputies, on the night of this Wednesday (8). The text received a favorable opinion from congresswoman Maria do Rosário (PT-RS), rapporteur at the Constitution, Justice and Citizenship Commission (CCJ). The project, by Deputy Tabata Amaral (PSB-SP), establishes a new classification in the Penal Code and defines a prison sentence of 2 to 6 years. In the situation where sexual activity is consummated, the penalty is aggravated and becomes 6 to 10 years of imprisonment. If the agent is a public official, it will be added to the one that deals with a crime against the public administration.

Tabata Amaral cited data from the organization Transparency International, according to which, in 2019, in Latin America, one in five people was a victim or knew victims of this type of conduct when they sought some public service.

Rapporteur Maria do Rosário said that the project’s approval will fill the existing legislative gap in Brazil, “but will also serve as an international reference in the face of the gap also existing in the laws of other countries and in international treaties and conventions.”
