The Association of Horizontal Property Administrators (PH) provided statements on the guilty plea issued by the Trial Court of the First Judicial Circuit of Panama on the administrators in the case where there was an explosion in apartment number 2 of tower 7 of the PH Costa Mare.
“The unions of PH administrators are deeply concerned about the guilty plea for the unfortunate event that occurred at PH Costa Mare, since we perceive that it is ignoring that administrators do not have free access to private properties and that the decision does not It is in line with what is established by Law 284 of 2022 regarding horizontal property, which indicates that the responsibility of the inmates of the apartments is the responsibility of the owner”, says the lawyer specializing in PH, Mario Vargas.
The obligation of the owner or occupant of the property is stipulated in article 56 No. 6 of Law 284 of 2022, which establishes: “It is an obligation of the owners to keep their real estate unit and the elements that comprise it in good condition.”
PH administrators are responsible for the common areas of the PH, but the owners are responsible for their real estate units, so they must hire suitable people to handle gas systems, as it is stipulated in the same Law that prohibits ” hire unsuitable personnel for the repair, maintenance and upkeep of electricity, plumbing, gas installations and any other that requires suitability or certification to be exercised”.
