This Holy Thursday and Good Friday is a non-working holiday and without substitute rest, but what happens if you work and your employer does not want to recognize the triple payment, even though you are on the payroll. Here we tell you what you have to do step by step.

On Thursday, April 14 and Friday, April 15, all workers have the right to enjoy paid rest on both dates, in accordance with Legislative Decree No. 713, which dictates the rules for the payment of paid rest.

HOW MUCH SHOULD I BE PAID IF I WORK DURING EASTER THIS 2022?

If you work on Holy Thursday and Good Friday you will receive a triple payment. In accordance with Legislative Decree No. 713, the work carried out on non-working holidays without substitute rest will give rise to the payment of the corresponding remuneration for the work carried out, with a surcharge of 100%.

Thus, private sector workers who agree with their employers to work on Good Thursday or Good Friday or both days, without subsequent substitute rest (they will not recover the day worked), must receive triple remuneration. The measure also applies to workers who perform remote work,

WHAT HAPPENS IF I DO NOT RECEIVE MY TRIPLE PAY FOR WORKING EASTER HOLIDAYS?

If your employer does not comply with the labor regulation, you can file a virtual complaint with the National Superintendence of Labor Inspection (Sunafil), following the steps below:

WHAT HAPPENS IF I WORK HOLIDAY, BUT I RECOVER IT LATER THE DAY?

Workers who agree to work on Good Thursday or Good Friday with a subsequent substitute rest (to be taken the day after) receive double daily remuneration: one for the holiday and another for the work performed.

IF I HAVE MEDICAL REST, DO I GET PAID EASTER HOLIDAYS?

That’s how it is. If you are on medical leave on April 14 and 15, which coincides with the first 20 days of health leave in 2022, the employer must pay for holidays without having worked. If the break is after the 21st, the employer pays for the holidays, not as remuneration but as a subsidy, which is reimbursed by EsSalud.
