Holocaust at the Palace of Justice: Firm condemnation against five senior Army commanders

The Supreme Court of Justice confirmed the sentence of 40 years in prison against the retired colonel Edilberto Sánchez Rubiano, the then captain Oscar William Vasquez Rodriguez and three former members of the B-2 unit of the National Army as co-perpetrators of the forced disappearance of various survivors of the takeover and retake of the Palace of Justice in 1985.

According to the Court, the Colonel and Captain, along with three other sergeants, were responsible for the disappearance of the administrator, a waitress from the Palace of Justice and Irma Francowho was identified as a guerrilla.

In the document, they clarify that the retention was irregular, since at no time was it recorded that the three victims had entered or left the Casa del Florero.

“It was conceived from the very moment in which the superior commands of the military authority ordered the retention of the suspects, immediately removed from public knowledge or from their relatives, because they were not registered as admitted and after leaving the Casa del Florero ”, explained the Court.

In the sentence, The Criminal Cassation Chamber ensures that the three sergeants were the ones who made the corresponding listssince they had enough experience in the fight against insurgency, for which reason these profiles were the result of the hostage selection study.

“In which any information that could reveal the passage of the victims through the first floor of that building was omitted; intervention that, without a doubt, became essential for the consummation of the crime of forced disappearance”, the sentence mentions.

Finally, the Supreme Court of Justice concluded that, according to the investigation, it was verified that the three victims left the building alivesince they demonstrated that the disappearance of the three people was planned within the retake strategy implemented by the Public Force.
