MIAMI, United States. – The Provincial Prosecutor’s Office of Holguín reported that “controls the criminal process” initiated to investigate the alleged crimes of “propaganda against the constitutional order and instigation to commit a crime” against the young people Ernesto Ricardo Medina and Kamil Zayas Pérez, whom it secured “with the precautionary measure of provisional detention,” according to an official note published on the social networks of that institution.
According to the Prosecutor’s Office, the process was opened after learning that from “the digital space identified as El4tico” “publications were made that incite the people, the members of the Revolutionary Armed Forces and the Ministry of the Interior to change the constitutional order of the Republic of Cuba; and defame the actions of the country’s political and social institutions.”
The note adds that “instruction proceedings are carried out to provide evidence and complete the investigations” and that, once concluded, the Prosecutor’s Office “will adopt the corresponding procedural decisions,” “with respect for the rights and guarantees enshrined in the Constitution and the laws.”
This ruling comes after the Popular Provincial Court of Holguín admitted an appeal for habeas corpus in favor of Medina and Zayas, detained since February 6, and will set a hearing for this Thursday, February 12, at 9:00 am, at their headquarters.
As reported by the NGO Ciudadanía y Libertad, the Court’s admission document, signed by the president of the First Criminal Chamber, Marcos Michel Betancourt Leyva, ordered the Holguín Provincial Prosecutor’s Office to rule “immediately on the legality of the detention, the causes charged and the conditions in which both young people are found.”
He habeas corpuss was presented on Monday by Yanet Rodríguez Sánchez, friend of young people and collaborator of Ciudadanía y Libertad. The admission document recognizes that “the request alleges detention without notification of charges, without specification of crimes and without complying with legal formalities, which could constitute a violation of fundamental rights, which is why their immediate freedom is of interest.”
In addition, it is stated that Judge Betancourt indicated that the young people were prosecuted “in a complaint without specifying a number, from the Provincial Police Operations Unit” and that they have been detained “since February 6, 2026, without the reasons for the detention, the crime or the alleged facts being known so far.”
After the arrest, both young people were transferred to the province’s Criminal Investigation headquarters, known as “Everyone sings.”

Even the Spanish singer Alejandro Sanz shared in his Instagram stories a publication by the user “San Memero”, originally published on X, in which the arrest of the two young people is reported.
This Thursday, Ciudadanía y Libertad reported that the hearing of habeas corpus in favor of Medina and Zayas in the Popular Provincial Court of Holguín It took place under a police cordon.
