Health reform: key points of the new bill submitted to Congress

He National Government does not give up in its attempt to restructure the national health system, something that was materialized with the filing of the New health reform project this September 13th.

In this new text, filed in the morning hours, the fifth article creates the National Health Council as the governing body of the Health System, attached to the Ministry of Health and Social Protection“.

According to the text, this Council will be made up of six representatives of the National Governmentas well as the Minister of Healthwho will preside over it, The Minister of Finance, the Minister of Labor, the Minister of Environment, the Minister of Science, the Director of the National Planning Department and a representative of the first-order territorial entities.

Likewise, this Council will have representation from groups of health workers, representative organizations of health professionals, patients, academia, among other groups.

The National Superintendent of Health and the director of the Health System Resources Administrator – Adres will be part of the National Health Council with voice but no vote. In turn, the National Health Council may invite institutions and natural or legal persons that it considers relevant.“, the text states.

Among the tasks that this new Council will have will be to recommend to the sectors and entities of the Government, as well as the actors of the health system, the definition and implementation of policies, strategies, plans and programs related to the intervention needs of the social determinants of health for management.

Meanwhile, in Article 6, the Ministry of Health proposes to create a unified and interoperable public information system. According to the article, the Government will create this system “to ensure transparent, online and real-time access to health and administrative transactions by each actor in the health system, according to their operational or strategic responsibilities, at the national, territorial and institutional level“.

According to the proposal: “The EPSs that are currently operating in the General Health Social Security System will continue to do so for up to two (2) years provided that they meet the permanence conditions that apply to them, plus those established in the transition period provided for in this law.“.

In the meantime, they will be able to transform into Health and Life ManagersEPSs that present a liability restructuring plan approved by the National Health Superintendency“.

During the two years of transition provided for in this Law, Health Promoting Entities (EPS) must carry out the statutory, structural, administrative and operational reforms that are necessary, to adopt their nature as Health and Life Management Entities, in accordance with the enabling requirements defined for this purpose by the Ministry of Health and Social Protection.“, the proposal reads.

In this order of ideas, during the period of time that they remain as EPS, the Ministry of Health will determine, according to the capacities of the Addressthe implementation of direct transfer, if it has not been implemented at the time of entry into force of the current law.

What will the Managers do?

In it Article 24the initiative indicates that the Managers “In coordination with the Primary Health Care Centers (Caps) develop all actions to identify, segment and analyze health risks for the population in charge in the territory for health management, including the healthy population.“.

The same way, “In coordination with the Departmental and District Health Directorates, participate in the organization and formation of the Comprehensive and Integrated Territorial Health Networks – RIITS for the functional subregions for health management, including Primary Health Care Centers (Caps), in accordance with the enabling standards defined by the Ministry of Health and Social Protection.“.

According to the reform project, the Managers will also be able to carry out health risk procedures in coordination with the Caps from the Primary Health Care to the provision of medium and high complexity health services, according to the organization of the Comprehensive and Integrated Territorial Health Networks (RIITS).

Regarding the remuneration of these entities, the Government proposes that “Five percent of the value of the Capitation Payment Unit assigned to finance the health care of the population of which the Manager participates in its comprehensive care will be recognized, according to the regulations of the Ministry of Health and Social Protection established for this purpose.“.

And he adds: “In the event that a Health and Life Manager does not comply with the established management standards, he/she will receive up to thirty percent (30 percent) less of his/her remuneration income, and in the event of a repeat offense in two consecutive periods, he/she will be subject to a special supervision measure by the National Health Superintendence, in accordance with the regulations defined by the Ministry of Health and Social Protection.“.
